Present Privacy Policy states the rules and conditions on which KS Logistyka LLC based in Warsaw, with address Powstańców Śląskich 103/1, 01-355 Warszawa, Poland, listed in register of entrepreneurs of National Court Registry by regional court of capital city Warsaw in Warsaw, XIII Commercial Division of the National Court Register, with National Court Register number 0000600558, tax number 5223053266 (named ‘KS LOGISTYKA’ further on), processes personal data including the personal data of clients and outsourcers as well as personal data which web user shares while viewing http://kslogistyka.pl/pl/ website and its foreign language versions (named ‘website’ further on).
- GENERAL PROVISIONS
- Privacy Policy describes the rules concerning processing of personal data by KS LOGISTYKA in order to establish and fulfil contracts with trading partners as well as facilitating information about services via webpage, including the basics, aims and range of personal data processing and the claims of the people whom the data concerns as well as information about the scope of usage of Cookies files and analytical tools by the website.
- Personal data collected via webpage or given to KS LOGISTYKA in other way (for example via phone call or e-mail message), in order to establish or fulfil the contract, are processed according to present law regulations including especially General Data Protection Regulation of European Union Council and Parliament 2016/678 dated 27th April, 2016 in terms of protection of individuals because of processing of personal data and in terms of unrestrained flow of such data and reversal of directive 95/46/WE (named ‘GDPR’ or ‘Regulation’ further on).
- Using the website as well as contact form is voluntary. So is facilitating data by the web user, with restriction that not including personal data required to reply for web user’s contact form message, results with the lack of such reply.
- KS LOGISTYKA is data administrator within the meaning of article 4, section 4 of GDPR and thus pays extra attention in order to protect the interests of people whose personal data is processed and guarantees that collected data is:
- processed according to the law regulations
- collected for specified reasons and is not given further process, not coherent with these reasons
- updated and collected only in the range allowing further accomplishment of designated purposes
- stored in a way allowing person identification of whom the data relates to, not longer than it is required in order to accomplish the purpose of process
- processed in a way that allows proper personal data safety, including protection against illegitimate or repugnant to the law processing, unauthorized access to the data and potential accidental loss, destruction or damage with the help of introduced technical or organizational measures

- KS LOGISTYKA is entitled to process personal data in the following cases, as at least one of the following conditions is fulfilled but also is entitled to do so in the range as follows:
- On the basis of article 6, section 1, letter a) of GDPR – when person whom the data relates to, agreed for personal data processing in one or more designated purposes.
- On the basis of article 6, section 1, letter a) of GDPR – when processing is essential in order to fulfil the contract, with the fact that the person whom the data relates to is party of it or to take measures on the person’s behalf before the contract is signed.
- On the basis of article 6, section 1, letter c) of GDPR – when processing is required in order to fulfil legal duty imposed on personal data administrator.
- On the basis of article 6, section 1, letter f) of GDPR – when processing is required for the accomplishment of legally justified interests pursued by personal data administrator or by third party except for the situation when paramount goal with these interests have interests or essential rights and freedoms of the person whom the data relates to and requiring protection of personal data, especially when the person whom the data relates to is a child.
- Personal data processing done by KS LOGISTYKA every time requires at least one of the essentials mentioned above to occur. This is why to better show and present the aims and core of personal data processing they are described and correlated in the third section of Privacy Policy.
- AIM, CORE, PERIOD AND RANGE OF DATA PROCESSING BY THE ADMINISTRATOR
- Every time the aim, core, period and range of data processing and their recipients come from the actions taken by the website user or client or outsourcer of KS LOGISTYKA.

RECIPIENTS OF SHOP USERS’ DATA
- In order for the website to function properly and to fulfil contracts correctly KS LOGISTYKA needs to use the service of outside parties ( for example software provider, warehouse and logistic service or accountant services). KS LOGISTYKA guarantees the fact that it uses only services provided by such processing entities who secure satisfying warranties of proper technical and organizational measures so that processing fulfils the requirements of the Regulation and protects the people, whom the data relates to.
- Giving data over to KS LOGISTYKA happens only in situation when it is necessary to fulfil one of the purposes of personal data processing.
- Personal data might be given over to the following recipients or categories of recipients:
- transporters/ principals of KS LOGISTYKA,
- service providers supplying KS LOGISTYKA with technical, IT or organisational solutions, allowing running business activity including website,
- providers of accounting, legal and advisory services.
PROFILING SHOP USER
- GDPR Regulation obligates the data controller to inform about the automatic decision making, including profiling which is mentioned in article 22, section 1 and 4 of the Regulation and – at least in these situations – to give important information over about the rules of how they are made, and about the importance and predicted consequences of such processing for the person to whom the data relates. Being mindful of it KS LOGISTYKA is going to quote in this chapter of Privacy Policy information about possibility of profiling.
- KS LOGISTYKA does not use software allowing to determine the identity of the website user on its website.

- KS LOGISTYKA allows the users of the website and its clients as well as outsourcers the implementation of right resulting from Regulation:
- the claim to accessing, correcting, limiting, deleting or transferring – the person whom the data refers to is entitled to require KS LOGISTYKA to access his or her personal data, to correct, delete (‘right to be forgotten’) or limit the processing and is allowed to raise an objection against processing as well as is entitled to transfer his or her data. Detailed conditions of executing mentioned titles are regulated by article 15 to 21 of GDPR,
- the claim to cancel the agreement at any time – the person, whose data is processed by KS LOGISTYKA is allowed to cancel the agreement at any point during processing, which does not influence the law of processing which KS LOGISTYKA was executing before the agreement had been cancelled based on the agreement previously given (article 6, section 1, letter a) of GDPR),
- the claim to bring a complaint to regulatory organ – the person, who states that his or her data is processed not according to common legal regulations in terms of protection of personal data by KS LOGISTYKA, is entitled to bring a complaint to regulatory organ, which is the Chairman of Office of Protection of Personal Data
- the claim to objection – the person, whom the data refers to is entitled to raise an objection at any time – because of that person’s specific situation’s reasons – considering processing personal data of such person, based on article 6, section 1, letter e) or f) of GDPR including profiling on the basis of those regulations
- the claim to objection of processing personal data considering direct marketing – if the data is processed for the needs of direct marketing, the person whose data is referred to, is entitled at any time to raise an objection against processing of his or her data for the needs of such marketing in the sphere in which processing is connected with direct marketing.

Those services help to analyse the website traffic. Collected data are processed within those services in an anonymous way (they are so called operating data which do not allow person identification) to generate statistics useful for website administration. This data is collective and anonymous, meaning that they do not include identifying characteristics (personal data) of the person viewing the website. Using those services data such as the sources and medium of acquisition of the person visiting the website as well as the way the person behaves within the website space, information about devices and browsers via which they visit the website, IP and domain, geographical and demographic data (age, gender) and interests are gathered

- The website might contain links to other websites. KS LOGISTYKA recommends studying privacy policies of those websites after entering them. This Privacy Policy relates only to website and processing of personal data done by KS LOGISTYKA.
- Present Privacy Policy went into effect on ____, 2020. KS LOGISTYKA reserves the right to change Privacy Policy if that would be necessary as possible modifications of website functioning could be introduced as well as its managing changes, the changes of law and conusance. The changes will go into effect after being published on website www.kslogisics.pl together with introduction of the date of their implementation.
